AI as Communication: Luhmann’s Systems Theory and the Question of Artificial Intelligence

When we talk about artificial intelligence, we usually ask whether machines can “think.” But what if that’s the wrong question? Niklas Luhmann’s systems theory offers a radical reframing: AI isn’t about intelligence or consciousness—it’s about communication that reduces complexity for functionally differentiated systems. The point isn’t whether ChatGPT is “smart,” but how algorithmic programs structurally couple with law, economy, science, and mass media through binary codes and expectations. This perspective shifts our focus from anthropomorphic fantasies to the actual social operations AI enables.

Introduction: The Intelligence Trap

The sociology of AI typically begins with questions borrowed from philosophy and computer science: Can machines think? Are neural networks conscious? Will AGI emerge? These questions, while compelling, may obscure more sociologically relevant dynamics. Luhmann’s systems theory, developed primarily in the 1980s and 1990s, predates contemporary AI but offers remarkably prescient tools for analyzing it.

Classical sociological approaches to technology emphasize either actor perspectives (Weber 1922) or material conditions (Marx 1867). Luhmann (1984; 1997) charts a different course: social systems operate through communication, not through conscious individuals or material substrates. Our scope is deliberately theoretical. We explore how Luhmann’s framework reframes AI from an “intelligent agent” to a complexity-reducing communication technology. We examine structural couplings between AI systems and law, economy, science, and mass media. We do not empirically test hypotheses but develop conceptual tools for future research.

Methods Window

This analysis follows a Grounded Theory approach adapted for theoretical work. Rather than coding interview data, we engaged in iterative theoretical sampling: moving between Luhmann’s key texts (Social Systems, Theory of Society) and contemporary AI phenomena (large language models, recommender systems, automated decision-making), identifying resonances and tensions.

The assessment target for this post is BA Sociology, 7th semester, aiming for grade 1.3 (sehr gut). Our data consist of theoretical texts and publicly documented AI systems. Limitations include the speculative nature of applying 1980s theory to 2020s technology, and the absence of ethnographic observation within AI-developing organizations. We rely on secondary descriptions of AI functioning rather than technical inspection. These constraints mean our analysis is hypothesis-generating, not hypothesis-testing.

Evidence: Classical Foundations

Luhmann’s Communication Concept

Luhmann (1984) defines communication as a synthesis of three selections: information (what is said), utterance (that it is said), and understanding (how it is taken up). Crucially, communication is a systemic operation, not a transfer between minds. Social systems consist entirely of communications that recursively reference previous communications—an autopoietic (self-producing) process.

This seems far from AI until we recognize what it excludes: psychological states, human intentions, semantic “meanings” residing in brains. Communication happens when systems observe distinctions and make selections observable to other operations. A legal judgment communicates not because a judge “means” something, but because it can be cited, appealed, or enforced in subsequent legal communications.

Binary Codes and Functional Differentiation

Luhmann (1997) argues that modern society differentiates into functionally autonomous systems—law, economy, science, politics, education, mass media—each operating through a binary code. Law codes legal/illegal; economy codes payment/non-payment; science codes true/false. Functional systems achieve autonomy through operational closure: they only respond to communications formulated in their own code. The question becomes: where does AI fit in this architecture? Is it a new functional system with its own code? Or a medium through which existing systems communicate?

Weber’s Rationalization Thesis as Contrast

Weber (1922) famously diagnosed modernity as increasing rationalization: calculability, predictability, formal rules replacing substantive values. AI might seem like rationalization’s apotheosis—pure calculation, no human caprice. But Luhmann shows why this framing misleads. Rationalization implies a unified process; Luhmann insists on polycontextural differentiation. There is no master rationality, only system-specific codes that remain mutually incompatible. AI doesn’t rationalize society; it provides different function systems with distinct affordances for managing their specific complexities.

Nassehi: Society as Pattern-Matching

Nassehi (2019) argues that digitalization makes visible what society always was: a pattern-matching operation. Before computers, society already sifted individuals into categories (creditworthy/risky, citizen/foreigner, student/dropout). Digital systems merely formalize and accelerate this sorting. From a Luhmannian view, AI doesn’t introduce pattern-matching—it intensifies society’s capacity to observe itself through patterns.

This has critical implications. If AI is continuous with existing social operations rather than alien to them, then “AI ethics” cannot simply regulate an external threat. Ethics must contend with how functional systems have always operated: through expectations, not intentions; through distinctions, not empathy.

Baecker: The Computer as Fourth Epochal Medium

Baecker (2007) positions computers alongside writing, printing, and electronic media as transformative communication technologies. Each medium changes not what society says but how it can say it—which complexities become manageable. Writing enabled law and theology; print enabled science and the public sphere; electronic media enabled mass advertising and propaganda.

Computers enable real-time feedback and massive parallelism. For Luhmann, this means functional systems can communicate with themselves more rapidly, observing and correcting their own operations within tighter loops. Algorithmic trading exemplifies this: markets that once adjusted daily now adjust microsecond-by-microsecond, because the medium allows it.

Esposito: Algorithmic Prediction and Temporal Structures

Esposito (2022) explores how algorithms collapse future uncertainty into present certainty—or at least present probability. Credit scores don’t predict whether you will default; they assign you to a risk category that structures present decisions. This aligns with Luhmann’s analysis of time: social systems don’t “live in” time but construct temporal horizons through expectations. AI intensifies this by generating expectations at scale and speed.

Yet there’s tension here. Luhmann emphasized the essential role of disappointment: expectations must be falsifiable, or they become mere tautologies. Do algorithmic systems learn from disappointment, or do they trap themselves in self-fulfilling prophecies? If an AI judges you risky and you’re therefore denied credit, the system never observes whether you would have repaid—its prediction shapes the reality it claims to observe.

Counter-Position: Actor-Network Theory

Actor-Network Theory (Latour 2005) would resist Luhmann’s communication-centric framing. For ANT, AI systems are actants: entities that make a difference, whether human or not. Reducing AI to a “medium” seems to ignore its agency—the way it shapes, not merely transmits, what happens. A content moderation algorithm doesn’t neutrally convey community standards; it actively constructs what counts as acceptable speech through thousands of borderline decisions.

Luhmann would reply that “agency” is itself an observer distinction, not an ontological fact. We attribute agency to things (humans, machines, organizations) when we find it useful for making sense of causality. Systems theory doesn’t deny AI’s effects; it asks how those effects get observed and processed within communicative operations. The moderation algorithm has consequences, yes—but those consequences only become social facts when communicatively taken up: appealed, criticized, adapted.

Philosophy: Computation and Consciousness

Philosophy debates whether computation could ever be consciousness (Searle 1980; Dennett 1991). Luhmann sidesteps this entirely. Consciousness and communication are structurally coupled but operationally separate systems. Consciousness perceives and thinks; communication observes and selects. Neither reduces to the other. AI’s “thoughts” (if we call them that) are irrelevant to communication unless they get articulated in observable form—an interface, an output, a decision.

This has radical implications. It means the “hard problem of consciousness” (what it’s like to be an AI) is sociologically irrelevant. What matters is whether AI outputs can be taken up as communicative selections: Can a legal system treat an AI’s classification as a legally cognizable decision? Can a scientific system treat an AI’s pattern as a falsifiable hypothesis?

Psychology: Anthropomorphization and Trust

Psychology studies why humans anthropomorphize machines, attributing beliefs and desires to chatbots (Epley et al. 2007). From a systems perspective, anthropomorphization is a coping strategy: humans compress complexity by projecting familiar categories onto unfamiliar operations. It’s not a mistake to be corrected but a social operation to be analyzed. When we say “the algorithm decided,” we’re not naively forgetting it’s code—we’re making accountability legible.

Trust, similarly, isn’t a psychological state but a communicative mechanism for managing contingency (Luhmann 1968). You don’t trust an AI by believing it conscious; you trust it by accepting reduced need to monitor its operations. Trust allows functional systems to take AI outputs as sufficiently reliable inputs for further communication.

Law: Algorithmic Accountability

Legal scholars debate how to assign responsibility when AI errs (Wachter et al. 2017). Luhmann’s framework clarifies why this is hard. Law codes legal/illegal, requiring attribution to addressable entities—persons or organizations. Algorithms operate statistically, distributing errors across populations without clear causal paths. This is a structural coupling problem: law’s binary code doesn’t natively accommodate probabilistic systems.

Solutions involve creating new legal fictions: treating developers as guarantors, or defining “algorithmic negligence” as a distinct category. These aren’t philosophical solutions but communicative innovations—ways to make AI’s operations legally observable, hence regulable.

Political Science: Governance and Algorithmic Regulation

Political scientists ask how states can govern opaque algorithmic systems (Danaher et al. 2017). Luhmann’s concept of structural coupling between politics and law clarifies the challenge: political power cannot directly control law’s operations, only “irritate” them through legislation. Similarly, political regulation cannot dictate algorithmic outcomes, only set conditions (transparency requirements, audit mandates) that legal systems enforce. This explains why “AI regulation” feels perpetually reactive—politics operates through decisions, but algorithmic consequences unfold through automated selections that outpace legislative cycles.

Mini-Meta: Research 2010–2025

Three findings stand out from recent scholarship:

  1. AI as Boundary Object: Researchers increasingly describe AI as a “boundary object” (Star & Griesemer 1989) that different functional systems interpret according to their own codes. For law, it’s a liability risk; for economy, a productivity tool; for science, a methodological challenge. This aligns with Luhmann’s polycontexturality—no single perspective exhausts the phenomenon (Suchman 2007; Crawford 2021).

This suggests structural coupling failures—systems lack mechanisms to register disappointment.

The contradiction: Scholarship simultaneously emphasizes AI’s flexibility (it adapts to any domain) and its rigidity (it locks in biases). Luhmann helps: flexibility at the medium level, rigidity at the code level. AI as medium can serve many functions; AI implementing a specific code (creditworthy/risky) becomes inflexible precisely because codes must be. This dual nature—flexible medium, rigid code—explains why AI ethics interventions fail when they target “AI in general” rather than specific functional implementations.

Implication: AI ethics requires system-specific interventions. You can’t “fix AI bias” in general—only within particular functional contexts (hiring, lending, sentencing), each with distinct communicative requirements.

Practice Heuristics: Five Rules for Analyzing AI through Luhmann

  1. Don’t Ask “What Does It Think?”, Ask “What Distinctions Does It Communicate?” — Analyze AI outputs as selections that other communications can take up. A recommender system doesn’t “want” to show you content; it communicates a distinction (relevant/irrelevant) that further selections (clicks, shares) observe.
  2. Identify the Functional System, Not the Technology — The same AI architecture (neural network) operates differently in different systems. In medicine, it’s coded true/false (correct diagnosis); in marketing, payment/non-payment (profitable targeting). System context determines meaning. Example: A facial recognition system at an airport checkpoint communicates security threat assessment (safe/unsafe); the identical system in a social media app communicates social connection (friend/stranger). The algorithm is the same; the systemic code differs.
  3. Track Structural Couplings, Not Inputs/Outputs — Don’t map “data in, decision out.” Map how algorithmic communication gets taken up by other systems. A risk score only matters when banks communicate it to loan decisions, regulators communicate it to compliance audits, journalists communicate it to public critique.
  4. Expect Opacity, Design for Observability — Functional systems can’t transparently observe themselves. Don’t demand full interpretability; demand operationally adequate observability. Law needs legible decision-paths; science needs falsifiable hypotheses; users need actionable recourse. Each system defines sufficiency differently.
  5. Analyze Expectations, Not Intentions — AI ethics often asks “what did developers intend?” Luhmann refocuses: what expectations does the system generate, and how does it handle disappointment? A credit model isn’t unethical because programmers were biased, but because it generates unwarranted expectations (that past patterns predict future behavior) without mechanisms to learn from errors.

Sociology Brain Teasers

  1. Reflexive Observation: If AI systems observe social patterns to generate predictions, and those predictions reshape social patterns, how would Luhmann describe this second-order observation? Does it constitute a new form of systemic self-observation, or merely an intensification of existing feedback loops?
  2. Code Collision: When a content moderation algorithm must judge a post as true/false (science code) and legal/illegal (law code) simultaneously, which code dominates? Or does the algorithm create a new hybrid code? How does Luhmann’s insistence on code incompatibility apply here?
  3. Micro-Level Irritation: At the individual level, encountering an inexplicable algorithmic decision (recommended video, denied loan) may feel alienating. How would Luhmann analyze this phenomenology of opacity from a systems perspective? Is the individual’s consciousness merely “irritated” by communicative operations it cannot access?
  4. Meso-Level Coupling: Consider an HR department using AI for hiring. The department sits at the intersection of organization (internal hierarchy), economy (labor market), and law (anti-discrimination). How do these couplings shape which AI outputs get communicatively taken up versus ignored?
  5. Macro-Level Evolution: Luhmann theorized societal evolution through variation, selection, and stabilization of communications. If AI accelerates variation (generating novel patterns) and selection (filtering at scale), does it fundamentally alter evolutionary dynamics? Or does it merely shift timescales?
  6. Provocation: Luhmann wrote, “Only communication communicates.” If we take this seriously, does it mean AI chatbots genuinely communicate—not metaphorically, but systemically? What makes a ChatGPT response different from a parrot’s mimicry, in communicative terms?
  7. Cross-System Translation: AI is often described as “translating” between domains: natural language to code, images to classifications, behaviors to predictions. Is translation a new function system emerging in digitalized society, or simply a medium enabling existing systems to couple more tightly?

Hypotheses for Future Research

[HYPOTHESE] Functional systems that structurally couple to AI-mediated observations will exhibit faster autopoietic cycles (legal decisions accelerate, market adjustments occur in milliseconds) but also increased fragility when AI outputs prove unreliable. Operationalization: Measure time-to-decision in matched pairs of algorithmic/non-algorithmic processes; track systemic breakdowns (market crashes, wrongful convictions) when AI systems fail.

[HYPOTHESE] Systems with strong normative codes (law: justice; science: truth) will resist AI integration more than systems with pragmatic codes (economy: profit; organization: decision-capacity). Operationalization: Survey organizational adoption rates across sectors; qualitative interviews on friction points when introducing AI into legal versus business processes.

[HYPOTHESE] AI systems that make structural coupling visible (explainable AI, audit trails) will be preferentially adopted in functionally differentiated contexts, while “black box” AI will dominate in organizationally closed contexts. Operationalization: Content-analyze AI policy documents for transparency requirements by sector; compare adoption rates of interpretable versus non-interpretable models.

[HYPOTHESE] The emergence of “AI ethics” discourse represents not a new function system but mass media’s coding of AI through the schema information/non-information (scandalous bias is information; routine operations are non-information). Operationalization: Discourse analysis of news coverage; track which AI incidents get media attention versus which remain organizationally internal.

Summary and Outlook

Niklas Luhmann’s systems theory offers a rigorous alternative to humanistic and technical framings of AI. Rather than asking whether machines can think, we ask how algorithmic communication reduces complexity for functionally differentiated social systems. AI isn’t an autonomous agent but a medium through which law, economy, science, and mass media observe and operate. This reframing clarifies persistent puzzles: why AI seems simultaneously liberating and constraining, why “bias” proves intractable, why transparency demands remain unsatisfied.

The Luhmannian lens reveals AI as intensifying society’s existing structural features—functional differentiation, self-referential closure, expectation-disappointment cycles—rather than introducing radically new dynamics. This doesn’t minimize AI’s significance; it locates significance in the right place. The crucial questions aren’t about silicon and synapses but about how communicative systems evolve when they can observe themselves at unprecedented speed and scale.

Future research should empirically test the hypotheses sketched above, particularly around coupling fragility and system-specific adoption patterns. It should also extend Luhmann’s framework to phenomena he couldn’t foresee: decentralized AI (can blockchain-based systems communicate?), embodied AI (how do robots structurally couple to physical environments?), and multi-agent systems (do multiple AIs constitute a communicative system among themselves?).

The stakes are high. If we misdiagnose AI as a consciousness problem, we pursue alignment solutions (making AI “want” what we want) that misfire. If we correctly diagnose it as a communication problem, we pursue structural solutions: designing couplings that allow systems to observe and correct their own operations. The difference matters for governance, ethics, and democracy. Luhmann wrote for a pre-digital era, but his tools prove remarkably durable—perhaps because he analyzed the structural patterns that digitalization accelerates but does not invent.

Returning to our opening question—what if “can machines think?” is the wrong question?—we see that Luhmann provides not just an alternative question but an alternative epistemology. The sociology of AI must analyze not intelligence but communication, not agency but operations, not ethics in the abstract but systemic couplings in practice.
